BlueMercury – Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”) and UVCODEX LLC (“Company,” “we,” “us,” or “our”). These Terms govern your access to and use of the mobile application (“Application”). By downloading, installing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Application.

1. Eligibility

1.1 Age Requirement

You must be 18 years of age or older to download, access, or use the Application.
By using the Application, you represent and warrant that you meet this age requirement.
If you are under 18, you are strictly prohibited from using the Application.

2. Grant of License

2.1 Limited License

Subject to your compliance with these Terms, UVCODEX LLC grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the Application on a device that you own or control.

Purchasing, downloading, or accessing the Application does not grant you ownership of the Application or any associated intellectual property.
All rights not expressly granted remain the exclusive property of UVCODEX LLC.

2.2 Prohibited Activities

You may not:

  • Copy, reproduce, distribute, or create derivative works of the Application
  • Reverse engineer, decompile, or attempt to extract source code, except as permitted by law
  • Sell, rent, lease, sublicense, or transfer the Application
  • Use the Application for unlawful, unsafe, or unauthorized radio communication
  • Interfere with or misuse regulated radio frequencies or communication devices

3. Open-Source Components

3.1 Use of Open-Source Code

Certain components of the Application may be licensed under open-source terms.
Use of such components is governed solely by the applicable open-source license.

3.2 Proprietary Features & Commercial Licensing

All proprietary elements of the Application, including the compiled Application, source code (excluding open-source components), user interface, integrations, and premium features, remain the exclusive property of UVCODEX LLC.

Any commercial use, redistribution, modification, or integration involving proprietary components requires a commercial license agreement from UVCODEX LLC.

4. Separate Hardware Requirement

Use of the Application may require a separate, user-provided radio device, which must be independently obtained, configured, and maintained by the User.
UVCODEX LLC does not manufacture, supply, endorse, authorize, or warrant any radio devices or third-party hardware.

You are solely responsible for:

  • Ensuring the radio device is compatible
  • Proper device configuration
  • Compliance with all applicable radio-frequency laws and regulations
  • Safe operation of all hardware used with the Application

UVCODEX LLC assumes no liability for hardware function, failure, misuse, or regulatory violations.

5. User Responsibilities

You agree to:

  • Operate all radio hardware lawfully and safely
  • Follow applicable communication and radio-frequency regulations
  • Avoid harmful interference or unlawful transmission
  • Protect your devices, data, and connected equipment
  • Use the Application responsibly and in accordance with all safety guidance

6. Disclaimers and Limitations of Liability

6.1 No Warranty

THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
UVCODEX LLC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2 Device and Hardware Damage

UVCODEX LLC is not liable for:

  • Damage to mobile devices, radios, accessories, or connected hardware
  • Electrical failures, overheating, or battery issues
  • Improper setup or misuse of radio equipment
  • Interference or disruption of radio communications

All risks associated with external hardware rest solely with the User.

6.3 Data Loss

UVCODEX LLC is not responsible for:

  • Data loss, corruption, or inaccessibility
  • Sync failures or transmission errors
  • Failures caused by third-party services or storage systems

6.4 Limitation of Liability

To the fullest extent permitted by law, the total liability of UVCODEX LLC shall not exceed the amount paid by you for the Application, if any.

UVCODEX LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

7. Modifications

UVCODEX LLC may modify, update, suspend, or discontinue the Application or these Terms at any time.
Continued use of the Application constitutes acceptance of any modified Terms.

8. Termination

We may terminate your license at any time for violation of these Terms.
Upon termination, you must discontinue use of the Application and delete it from all devices.

9. Governing Law

These Terms are governed by the laws of the State of [Your State] and the federal laws of the United States, without regard to conflict-of-law principles.
